Terms and Conditions
The purchaser is the individual, corporation or other entity that has made an offer to buy any art work produced by Tim McCarthy-Godwin.
The artist is Tim McCarthy-Godwin producing work as Tim Godwin and trading as Tim Godwin Art.
All work is checked for close colour matching and sizing before publishing either in print form or on the website. Prints are sold at a size as close to the original ratio as possible although some variation can occur. The purchaser accepts that when buying printed work some variation in print ration and colour can occur.
In paying the price indicated/agreed for the work the purchaser agrees to the following:
- Transfer of legal title: Until full payment is received in cleared funds the work will not be delivered and title will not pass.
- Copyright: As the artist and creator of this work I retain full copyright of the work. As the purchaser I grant you the license to use an image of this work for non-commercial purposes. Copyright remains with the artist for his lifetime and with his estate for 80 years thereafter.
- Shipping and Insurance: For items sent to the UK shipping and insurance is included within the amount paid unless agreed between the artist and the purchaser on discounted items. In the case of items shipped other than to the UK the buyer will pay for all shipping costs, insurance and any additional taxes incurred in the import/export of the work. The artist will ensure that all works are suitably packed to prevent any damage in normal transit conditions.
- Right of First Refusal: As an artist I want to keep control over my secondary market. If you decide to sell or dispose of the work by any means you will initially offer me the opportunity to buy it back at a reasonable price.
- Jurisdiction: This transaction is made under English Law and any disputes will be subject to English Law and Courts.
- A copy of our complaints procedure can be provided on request by email.
- Refunds and Returns: Works can be returned and refunded in the case of accepted mis-description or damage caused in transit only provided they are returned in the original packaging, without damage and with the purchaser responsible for the costs of return. Once the work is received and checked for damage a refund will be provided subject to a £10 administration fee in respect of prints and a £20 administration fee in respect of original artwork.
- Should the purchaser wish to return the item then this can only be done within 21 days of receipt and notified to Tim Godwin at timgodwin@timgodwin.art providing photographs of damage and damaged packaging or details as to the alleged mis-description. Given the nature of artwork and reproduction a simple statement of ‘not as described’ will not be acceptable reason for return.
